Business resumes after Hurricane Sandy hits U.S Northeast.

Millions across the U.S. Northeast stricken by massive storm Sandy will attempt to resume their normal lives on Wednesday as companies, markets and airports reopen despite grim projections of power and mass transit outages around New York for several more days.


With six days to go before the November 6 elections, President Barack Obama will visit flood-ravaged areas of the New Jersey shore, where the storm of historic proportions made landfall on Monday. As his guide, he will have Republican Governor Chris Christie, a vocal backer of presidential challenger Mitt Romney who has nevertheless praised Obama and the federal response to the storm.
Leaders at all levels had immense amounts of work to do to bring a semblance of normality back to the densely populated Eastern Seaboard.
Sandy, which killed 40 people in the United States, pushed inland by dumping several feet of snow in the Appalachian Mountains, more than 8.2 million homes and businesses remained without electricity across several states as trees toppled by fierce winds tore down power lines.
Subway tracks and commuter tunnels under New York City, which carry several million people a day, were under several feet of water. The lower half of Manhattan remained without power after a transformer explosion at a Con Edison substation Monday night.
Hit with a record storm surge of nearly 14 feet of water, New York City likely will struggle without subways for days, authorities said. Buses were operating on a limited basis and many residents were walking long distances or scrambling to grab scarce taxi cabs on the streets.
Assessing the damage, officials with New York’s Metropolitan Transportation Authority said they would release a timetable of their recovery plans sometime on Wednesday.
Despite much of the city’s financial district being damaged by flooding, officials planned to reopen financial markets on Wednesday as well. How much activity could take place remained to be seen, however, as many workers may be unlikely to get to work without subways and commuter railroads from the suburbs.

And the deal for the reality show was reportedly brokered by Jim’s Uk-based management company Greyology Inc.
The reality show is expected to be based on the true life story of the actor famed to be Nollywood’s bad boy and it will give viewers access to all areas of his life.
The reality show is expected to hit the screen in some few weeks.

Manchester United has been promised a “horror show” as Wednesday was tagged ‘Fright Night’ as the night will be a night of vengeance.
And after Sunday’s thrilling Premier League encounter, which ended with a controversial 3-2 victory for the visitors, Chelsea has encouraged Blues fans to turn up in west London in Halloween attire.
Chelsea Manager Roberto Di Matteo who has been desperate for revenge as well as his Chelsea players as they will be hoping to mess up their arch rivals on Wednesday night, and to also use the win to book their place in the competition’s quarter-finals, chasing out Sir Alex Ferguson’s side from the Capital One Cup in the process.
Fans were urged to wear their scariest fancy dress costumes, in a bid to terrify the Manchester United players and help Chelsea secure an easy win.
“Wednesday night sees Chelsea take on Manchester United in the League Cup and it’s sure to be a brilliant match, but it also happens to be Halloween – the spookiest night of the year,” read a statement on the club’s official website.
“We want all ‘bridge kids’ who have tickets for the game to come along early and wear their best Halloween outfits so that we can help scare the United players and help the Blues get a win.
Chelsea promised to give United so much to worry on come Wednesday as the league leaders play host to United again in the  in the Capital One Cup.

The 2012 League Bloggers Awards Player of the Year and Best National Team Player has been ruled out for several months but if fit, he is a big boost for Keshi as he gradually aims to blend the home-based players and their foreign-based counterparts.
Niger Tornadoes’ Okey Azubuike and Tony Okpotu of Lobi Stars are also in the squad after U-20 duty with the Flying Eagles.
Also invited is captain of the home-based Eagles, goalkeeper Chigozie Agbim of Warri Wolves.
Nigeria Premier League champions, Kano Pillars, supplied the highest number of players – five- while Heartland FC and Wolves had four and three players respectively.

Williams sisters arrive Nigeria for women’s rights tour

American tennis super-stars Serena and Venus Williams on Tuesday arrived the Murtala Muhammed Airport in Lagos at about 3p.m (local time) with officials of ‘Breaking The Mould,’ BTM campaign who were on ground to receive them.

The visit of the Williams sisters is part of a two-nation tour that will see them play exhibition matches and train kids is aimed at promoting women’s rights.
The sisters having shared 22 major women’s singles championships between them are amongst the world’s and United States’ most successful athletes and their trip is aimed at promoting “the role that women play in shifting perceptions and encouraging development at all levels across the African continent”.
The sisters could only say a few words to pressmen at the airport as security operatives whisked them away immediately they arrived.
The Williams are scheduled to pay the Lagos State Governor Babatunde Fashola a courtesy at the State House on Wednesday, after which they will head to a tennis clinic at Ikoyi Club, visit a puberty education class for girls then play an exhibition match and head to South Africa on Friday, November 2nd.
The Williams sisters have played each other competitively in 23 professional matches since 1998, with Serena winning 13 of these matches. Their overall head-to-head series is 13–10.
Serena who is currently ranked number 3 in the world has played Venus 12 times in Grand Slam singles tournaments and 11 times in other tournaments (including 11 finals).
They have met in eight Grand Slam finals, with Serena winning six times. Beginning with the 2002 French Open, they played each other in four consecutive Grand Slam singles finals, which was the first time in the open era that the same two players had contested four consecutive Grand Slam finals.

Abia state shuts down over 100 illegal schools.

 

Over 100 illegal schools have been shut down by the Abia state government across the state. The schools include primary, secondary and nursery schools.

The state government has sealed the premises of the affected schools while it has set up a tribunal to try the operators of the school.
Commissioner for Education, Mrs. Monica Philips, who disclosed this to newsmen at a briefing in Umuahia yesterday, said the illegal schools were used to perpetrate examination malpractices in the state.
She said “despite previous warnings to illegal private schools and advice that their operators upgrade them; they refused hence the decision to close them”.
Philips did not, however, disclose the exact number of schools affected by the closure, but noted that they “were hundreds”.
She said “officials of the ministry were still going round the state to identify other illegal schools”.
The commissioner also said only teachers or examination administrators who undergo training on examination ethics will be allowed to participate in the conduct of examinations in the state.
Philips said only those who participated and passed the examination administration Integrity and technical certificate workshop held recently in the state by the ministry, in conjunction with Exam Ethics Marshal International, would be involved in the conduct of school examinations in the state.
According to her, the measures are part of government’s effort to ensure that the standard of education in Abia remains high.
She said Governor Theodore Orji was in support of the ministry’s effort to ensure that examinations conducted in the state were credible and reliable, adding that the governor wanted the policy of zero tolerance for examination malpractices maintained in the state.

Alleged Money laundering: The arrest rumour is a “wicked lie”- Oyo state government.

 

The Oyo state government has denied the alleged arrest of the wife of the state governor over money laundering charges in the United Kingdom.

“That’s not true, there is no iota of truth in that” the commissioner for Information, Mr Bosun Oladele told Channels Television in a telephone interview.
The commissioner also confirmed that the first lady traveled to London on Sunday with her 14 year old daughter but confirmed that she has returned from the said trip said the Oladele.
To debunk the claim of the arrest, Mr Oladele said “We have a correspondence from the Metropolitan Police claiming that nothing like that is on the record”.
He said a correspondence was received from an official of the Directorate of Media and Communication of the London Metropolitan Police.
The commissioner said “He confirmed that nothing of such is on record and that the wife of the governor was never arrested”.
He described the allegation as a “wicked lie” claiming that the government has excelled in many areas of  development and traducers are trying to use the “Pull me down syndrome” to rubbish their achievements.

Mr Oladele also denied another allegation that the first lady has traveled 52 times over the period of 12 months.
“That is not true, the truth is that the first lady travels even prior to 2007 more than she does now” he said.
He further said that “now that she and her husband are in office she has to do that less. So it is untrue, if you look at 52 times and you put that on weekly basis, it means she has traveled every week since her husband became governor”.
He said the first lady returned to the country to clear the rumour making rounds that she has been arrested.
Oladele said the state government has sued the publishers of PM News and Newsleak (an online news agency) for making libelous reports on Mrs. Florence Ajimobi, seeking N1 billion in damages.
The news agencies had reported that wife of the Oyo state governor, Mrs. Florence Ajimobi  was arrested by the London Metropolitan Police with the sum of 400,000 pounds sterling on arrival at the United Kingdom.

The Octomom is in rehab. Nadya Suleman checked into the Chapman House Treatment Center last week to deal with “anxiety, exhaustion, and stress” stemming from an addiction to Xanax.
“Ms. Suleman has been taking Xanax that was prescribed by her doctor to deal with her anxiety but she felt she needed a treatment program to help with her recovery,” her representative said in a statement to ABCNews.com. “She will be in treatment for 28 days or more if needed.”
The rep noted, “Although the rehab offered to treat her at no charge, Ms. Suleman opted to pay for the program.”
Suleman reportedly left her 14 children in the care of three nannies and a couple of friends. She filed for bankruptcy earlier this year but appears to have come into cash after launching her adult film career. Earlier this month, she gave the website Rumorfix a tour of her new, 5,000-square-foot Palmdale, Calif. home.

Gunmen suspected to be armed robbers have killed 20 people in Kaboro village in Zamfara state northwest Nigerian. Local Government spokesman, Nuhu Salihu Anka, said on Wednesday.

12 men armed with guns stormed Kaboro village early on Tuesday morning, demanding money before shooting and hacking people to death, local residents said.
After several people had been killed, the area’s chief appealed to the gunmen to stop firing, but they turned their weapons on him instead, according to the spokesman.
“They were all shot to death while the village head was slaughtered with a sword,” local government spokesman Salihu Anka told Reuters by phone.
At least 27 people were killed in June when suspected armed robbers attacked several villages in Zamfara.
This killing comes on the heel of Sunday’s attack on a Catholic Church in another north central state, Kaduna.
A suicide bomber drove a jeep full of explosives into a church in Kaduna, about 70 miles (113 km) from the Zamfara border, killing eight people and triggering reprisals that killed at least two more.

Brttney spears past came back to haunt her again today, as Adnan Ghalib, the paparazzo she once dated, recounted their romance and her downward spiral during 2008.
Ghalib, 40, said he went from photographing the pop star to dating her in December 2007. He testified that he saw her “daily” during their time together and denied that he ever saw Spears’ former “manager” Sam Lutfi hide her cell phones, cut off phone lines, or withhold access to her dog, all allegations that Spears’ parents have made against Lutfi.
Ghalib alleged that Spears’s mom Lynne once tried to get him to speak negatively about Lutfi.
“She requested that I say [to the press] Sam Lutfi was responsible for Britney Spears’s behavior,” he said.

According to People magazine, during cross-examination, Ghalib said he bought a disposable cell phone at Lutfi’s request to be smuggled to Spears in mid-2008, months after her father obtained legal control over her. He also confirmed that a judge ordered him to stay away from Spears for three years and admitted he was once arrested while evading a process server in the case.
Spears’ father, Jamie Spears, took the stand after Ghalib. He testified that he never chased Lutfi around the kitchen counter and that he never punched him, allegations that Lutfi made against him last week.
Lutfi’s mother, sister and several other family members appeared in court today for the first time.
Lutfi’s case against the Spears family is expected to conclude Tuesday, and the pop star’s legal team will begin their defense. Lutfi is suing Spears for unpaid fees during the time he supposedly served as her manager, Jamie Spears for allegedly punching him, and Lynne Spears for purportedly defaming him in her 2008 book about her daughter’s breakdown.

It blasted the ocean itself over dunes, seawalls and berms and into downtowns, tunnels and subways. It killed dozens of people, destroyed famed landmarks and amusement parks, pushed houses off their foundations and toppled trees. It virtually shut down New York City, the nation's largest city, with major airports, highways, and bridges and tunnels in and out of Manhattan shut down, just as they were after 9/11.
For millions of people in New York City and elsewhere, the lights remain out, communications remain down and floodwaters, downed trees and power lines still make roads impassable.
However, some of the hardest-hit areas on the East Coast were beginning to take the first steps towards recovery. For instance, some New York bridges, tunnels, highways and airports reopened or were slated to be reopened by Wednesday morning.
So far, Sandy has been blamed for at least 50 people, according to The Associated Press, and left more than 8 million customers without power. The number of dead continued to rise by the hour a day after the storm made landfall near Atlantic City, N.J., and rocked states including New Jersey, New York, Pennsylvania, Connecticut, Maryland, North Carolina and West Virginia.
"I just never thought I would see what I saw today -- ever," New Jersey Gov. Chris Christie said. "It won't be same. It will be different because many of the iconic things that made it what it was are not gone and washed into the ocean."

  Prosecutors say a teenager who allegedly confessed to killing a 10-year-old Colorado girl and attacking a runner also sexually assaulted the girl.
Seventeen-year-old Austin Sigg was charged as an adult with 17 counts in both cases Tuesday. They include four murder charges, including one for both murder and sexual assault.

Sigg didn't speak during the brief court hearing in Golden and didn't look at his relatives in the audience.
Eight relatives of Jessica Ridgeway of Westminster also watched proceedings, including her mother. Each wore purple, Jessica's favorite color.
Defense attorneys anticipate asking the judge to send the case to juvenile court.

Woman Dies After Hurricane Sandy Ship Rescue.

 A woman who was rescued in the Atlantic Ocean by the Coast Guard after abandoning ship in rough weather churned up by Hurricane Sandy has died.
Coast Guard Petty Officer 3rd Class David Weydert said 42-year-old Claudene Christian was unresponsive when she was pulled from the water Monday evening and was later pronounced dead at Albemarle Hospital in Elizabeth City, N.C., early Tuesday morning, according to The Associated Press.
Fourteen people were rescued from the tall ship HMS Bounty early Monday morning off the coast of North Carolina.

Crews are still looking for Robin Walbridge, 63. The Coast Guard identified Walbridge as the ship's captain.
"The last time I spoke to her, she told me, 'If I go down with the ship, remember how happy I was,''' Christian's mother, who is also named Claudene, told ABC News Monday night.
There are questions about why a distress call to the Coast Guard at 9 p.m. Sunday may have been rescinded. The crew remained on board the sinking ship for seven hours.
"It kept resonating with me that they didn't ask coast guard for help the first time. Lives are more important than the ship," said Christian.

Claudene Christian and Walbridge were washed into the sea when the three-masted replica of the historic ship began taking on water. The crew was abandoning ship during the night when the hurricane flung them into the sea.
"What we know is that the whole crew was getting ready to board the life rafts, and as they were about to board, three people ended up on the water. One was able to get out [of the water] and get into rafts," Coast Guard Lt. Junior Grade Brendan Selerno told ABCNews.com Monday

Connie Britton is joining “Friday Night Lights” TV series creator Peter Berg in slamming Republican presidential candidate Mitt Romney for using the show’s “Clear Eyes, Full Hearts, Can’t Lose” motto during his campaign.
In a USA Today editorial co-written with Sarah Aubrey, the executive producer of “FNL,” the erstwhile Tami Taylor and current star of ABC’s “Nashville” accused Romney of co-opting the slogan and argued that President Obama more accurately embodies the phrase.
“‘Clear Eyes, Full Hearts, Can’t Lose’ wasn’t just about winning games,” Britton and Aubrey wrote. “Rather, it was a rallying cry of hope and optimism in a community where everyone had a fair shot — no matter their background, no matter their parents, no matter their gender. And no matter their politics.

“Dillon [the fictional town where 'FNL' is set] is a classic American town filled with hard-working, middle-class Americans, who just want to lead productive, healthy lives. And the women we represented on the show — the women we are in real life — are like the millions of women across the nation. Women who want to make our own health care decisions. Back down, Yoko Ono haters: in a new interview, Paul McCartney says John Lennon’s widow didn’t break up the Beatles.
According to the L.A. Times, Sir Paul reinforced the position Lennon often took before his 1980 death, telling interviewer David Frost that the group was breaking up with or without Ono’s influence.
“She certainly didn’t break the group up, the group was breaking up,” McCartney says. “I don’t think you can blame her for anything.”
He adds, “When Yoko came along, part of her attraction was her avant-garde side, her view of things, so she showed him another way to be, which was very attractive to him. So it was time for John to leave, he was definitely going to leave” with or without Ono in the picture.
The interview is scheduled to air Nov. 9 on the Al Jazeera English TV channel.

  The wrath of superstorm Sandy killed at least 33 people in seven states and left more than 8 million customers without power.
The 33 victims, the AP reported, died as the hurricane tore through states including New York, New Jersey, Pennsylvania, Connecticut, Maryland, North Carolina and West Virginia.
"This was a devastating storm, maybe the worst that we have ever experienced," New York City Mayor Michael Bloomberg said at a news conference today. Seventeen of the victims were in New York state and 10 of those were in New York City, according to the AP.
The power outages were spread over 18 states Virginia to Maine, and while the number of customers affected was 8 million, the number of people would be several times that number.
This morning, President Obama issued disaster declarations for New York and New Jersey so that federal aid will be offered to the affected areas to help supplement state and local clean-up efforts.


Sandy continued on a ferocious streak early this morning when a berm in Bergen County, N.J., was breached, resulting in four to five feet of water flowing into three towns and endangering as many as 2,000 people, said Jeanne Beratta, spokesperson for the Bergen County Office of Emergency Management.
"We're doing rescues by boat. We're doing rescues with large trucks. We're doing rescues all over those areas," Baratta told "Good Morning America." "It's going to continue all day because now we're just search and rescue."
New Jersey Gov. Chris Christie said that the state "kind of took it in the neck worse than any other place," but praised Obama and his administration for how they have handled the crisis.
"[Obama] called me last night around midnight to ask what else can be done," Christie told GMA. "I have to say, the administration, the president himself and FEMA administrator Craig Fugate have been outstanding with us so far. We have a great partnership with them and I want to thank the president personally for his personal attention to this."


In New York, the U.S. financial markets closed for a second day today, an unprecedented move for the stock exchange. In Lower Manhattan, the home of the financial district, a blowout at a Con Edison substation cut power to thousands of customers. The outage was likely the result flooding or flying debris, said John Miksad, senior vice president of electrical operations for the company.
Water flooded into parts of New York City's subway system as well as vehicle tunnels; the water even flowed into the site of the 9/11 terror attack. America's largest city was cut off from the outside world after Mayor Michael Bloomberg closed bridges and tunnels and transit systems shut down.

Texas Pastor Fatally Beaten Was 'Man of Integrity'

The Rev. Danny Kirk Sr. greeted everyone walking into his Texas church on Sundays with a big hug and an "I love you." His weekdays were spent visiting folks in the hospital or mowing lawns and doing household repairs for members in need.
Parishioners, who described Kirk as a dedicated minister with a bubbly personality and a knack for remembering the names of his church's 800 members, are now looking for answers following his violent death.
Police in the Fort Worth suburb of Forest Hill said Kirk was killed Monday by a man who rammed a car into a wall at his Greater Sweethome Missionary Baptist Church, then chased Kirk and fatally beat him with an electric guitar.
Investigators said they don't know the motive or if Kirk knew his attacker, who police subdued by using a Taser but who died after being taken into custody. His name hasn't been released.
Hundreds of people gathered outside the church, where crime-scene tape was wrapped around a small statue of Jesus near the wrecked car. Some hugged each other and cried, while others shared memories of Kirk.
"He really was concerned about our souls," Montoya McNeil, a church member for eight years, said as she wiped away tears. "You looked forward to being here. ... I'm not asking God why, because I know where he (Kirk) is, but we won't get those big bear hugs and those great sermons anymore."


Forest Hill Police Chief Dan Dennis said the suspect drove his car into a church wall before noon Monday, apparently on purpose. The suspect got out of the car and began to attack the pastor in the parking lot before chasing him into the church, while the secretary hid and called 911, Dennis said.
Police arrived to find the suspect assaulting Kirk with an electric guitar from inside the church, Dennis said. An officer used a Taser on the suspect, handcuffed him and put him in the back of a patrol car.
By then, Kirk had died, Dennis said. A maintenance worker who tried to help Kirk was injured and taken to an area hospital. His condition was unknown.

Dennis said the suspect was found unresponsive shortly after being detained and was pronounced dead at a local hospital. Kirk fought back during the attack, Dennis said, but it's unclear if that played any role in the suspect's death. An autopsy was being performed on the suspect to determine the cause of death.

Paramedics and other medical workers began to evacuate patients from New York University Langone Medical Center due to a power outage caused by Tropical Storm Sandy, followed by a failure of backup generators at the hospital, New York City officials said Monday night.
About 200 patients, roughly 45 of whom are critical care patients, were moved out of NYU via private ambulance with the assistance of the New York Fire Department, city officials said. ABC News' Chris Murphey reported a long line of ambulances outside of NYU Langone waiting to transport patients to other hospitals in the city.
The hospital had a total of 800 patients two days ago, some patients were discharged before tonight's evacuation, which was described by emergency management officials as "a total evacuation."

The patients were moved to a number of area hospitals and according to officials at NYU, the receiving hospitals would notify family members.
Sloan Kettering Hospital spokesman Chris Hickey confirmed to ABC News' Gitika Ahuja that it is receiving 26 adult patients from NYU, at their request. Hickey said she didn't know whether they had been admitted yet or what their conditions were.
NewYork-Presbyterian Hospital spokesman Wade Bryan Dotson said it is also accepting patients from NYU at both campuses, Columbia and Weill Cornell.
Meanwhile, ABC News affiliate WABC captured footage of patients being evacuated; among the first patients brought out of the hospital on gurneys was a mother and her newborn child.
On Monday morning, NYU Langone Medical Center had issued a press release that indicated the hospital's emergency preparedness plan had been activated and that there were "no plans to evacuate" at the time.
Shortly after the reports of an evacuation at NYU Langone, city officials reported that a second major New York City hospital, Bellevue Hospital, was about to lose backup power due to a generator failure.

Nearly two years after a neo-Nazi leader was gunned down at point-blank while sleeping on his sofa, his son who was 10 at the time of the killing is going on trial for murder.
Prosecutors want a judge hearing opening statements Tuesday to rule after the proceedings that the boy, now 12, murdered Jeff Hall, an out-of-work plumber who as regional leader of the National Socialist Movement headed rallies at a synagogue and a day labor site.
The boy told police he pulled a .357-Magnum from a closet and aimed it at Hall's ear and pulled the trigger before running upstairs and hiding the weapon, according to court papers.
"He decided, as he put it, it was time to end the father-son thing," said Michael Soccio, chief deputy district attorney. "This child started at five years old being expelled from school for violence. ... His violence started way before his dad ever joined any Nazi party."
Soccio, citing a history of violent behavior including choking a teacher with a telephone cord, wants to keep him locked up as long as possible. If held responsible, the boy would become the youngest person currently in the custody of the state's corrections department.
The boy's public defender, Matthew Hardy, did not immediately return calls for comment.
Hardy told the New York Times his client has neurological and psychological problems and was exposed to neo-Nazi "conditioning" at home.
"He's been conditioned to violence," Hardy told the newspaper. "You have to ask yourself: Did this kid really know that this act was wrong based on all those things?"
The Associated Press is not identifying the boy — who is not charged as an adult — because of his age.
Hall, 32, who said he believed in a white breakaway nation, ran for a seat on the local water board in 2010 in a move that disturbed many residents in the recession-battered suburbs southeast of Los Angeles. The day before his death, he held a meeting of the neo-Nazi group at his home.
Hall had previously taken the boy — his oldest of five children — on a U.S.-Mexico border patrol trip and showed him how to use a gun, according to papers filed by police against the boy's stepmother alleging child endangerment and criminal storage of a gun.
Last year, the boy told investigators he went downstairs and shot his father before returning upstairs and hiding the gun under his bed, according to court documents. He told authorities he thought his father was going to leave his stepmother, and he didn't want the family to split up, Soccio said.
The boy's stepmother told authorities that Hall had hit, kicked and yelled at his son for being too loud or getting in the way. Hall and the boy's biological mother had previously slugged through a divorce and custody dispute in which each had accused the other of child abuse.
Kathleen M. Heide, a professor at the University of South Florida in Tampa who wrote "Why Kids Kill Parents," said children 10 and under rarely kill their parents and that only 16 such cases were documented between 1996 and 2007. Heide also said parenting and home life would undoubtedly play a role in the case.
"It would be inaccurate to say who the child's parents are is superfluous," she said. "That is going to have an effect on how the child grows up, on the values that child learns, on problem solving abilities, so all of that is relevant."
If a judge finds the boy murdered Hall, he could be held in state custody until he is 23 years old, said Bill Sessa, spokesman for California's Department of Corrections and Rehabilitation.
The state currently houses fewer than 900 juveniles.
"We don't have anybody that young," Sessa said. "We have had 12-year-olds in the past, but it's rare."

Attorneys for an Indiana boy sent to prison at age 12 for helping a friend kill the other boy's stepfather will ask an appeals court Tuesday to toss his conviction, arguing that he was tried as an adult by a judge who didn't consider whether the sixth grader was mature enough to understand what was happening.
Paul Henry Gingerich, who was sentenced to 25 years in prison under a plea agreement, is appealing his case to the Indiana Court of Appeals. Lawyers for Gingerich, who is now 14, want the case sent to juvenile court for a fresh start before a new judge.
But state attorneys argue that the boy gave up his right to appeal when he signed a plea agreement. They also say his parents believed the boy knew what he was doing.
Gingerich and a 15-year-old friend were convicted of shooting the friend's stepfather, 49-year-old Phillip Danner, after waiting for him in the living room of his home in April 2010 in northeast Indiana's Kosciusko County. The slaying was part of a plot to run away to Arizona with a third boy who was also 12, according to court documents.
Those documents show that Gingerich said he simply went along with his older friend and didn't believe he was serious about killing his stepfather. He said he closed his eyes when he fired the gun.
Gingerich was originally charged with murder, but he agreed to plead guilty to a lesser charge of conspiracy to commit murder in November 2010.


His attorney, Monica Foster, argues in court motions that a Kosciusko County judge waived the case to adult court within a week after prosecutors asked, spurning defense attorneys' request for a psychological evaluation and without holding a competency hearing even though "the mere sight of Paul ought to have been cause for pause."
She notes that the only psychologist to evaluate the boy raised doubts about his ability to understand his rights. Foster also cites scientific research showing that the areas of the brain that control judgment and impulse control are undeveloped in adolescents.
In addition, Foster argues, the judge rejected defense attorneys' requests for more time to prepare even though prosecutors hadn't turned over the evidence against Gingerich.
"Paul's counsel had grossly inadequate time to prepare for the single biggest event in his young client's life," Foster wrote.
The nonprofit Juvenile Law Center in Philadelphia is supporting Gingerich, arguing in a court brief that children "often lack the experience, perspective and judgment to recognize and avoid choices that could be detrimental to them."
Deputy Attorney General Angela Sanchez countered by saying Gingerich waived his right to appeal as part of the plea agreement, and that the psychologist who evaluated Gingerich didn't explicitly say he wasn't competent to stand trial.
"While a psychological evaluation presented at sentencing expressed concerns about some factors related to the defendant's competence, the doctor did not actually opine that the defendant was not competent," prosecutors said in a court brief.
State attorneys say Gingerich's parents told prosecutors that they thought the boy understood what he was doing when he signed the plea agreement and waived his right to appeal.
The 15-year-old, who also pleaded guilty as an adult to conspiracy to commit murder, was sentenced to 30 years in prison. The other 12-year-old, who was present but didn't enter the house, was sentenced to juvenile detention until age 18.

Two West Linn teenagers who went missing on Saturday while on a hike in southeast Molalla, Ore., have been found safe, rescuers reported Monday.
Jackson Chandler, 17, and 16-year-old Bradley Nelson went on a day hike in the Table Rock Wilderness area. When they did not return, their parents called Clackamas County Search and Rescue on Saturday.
“We have a break in the rain now and the Oregon Army National Guard are flying out a helicopter hoping to locate them from the air,” said spokesman Deputy Nate Thompson. “We already deployed 50 searchers in the area, trying to locate them.”
Chandler and Nelson both go to West Linn High School. They are active Eagle Scouts and are experienced and trained hikers. But constant rain, rough terrain and the possibility that they’re stranded in the middle of the wilderness have been causes for worry.
 ”If they have the right amount of equipment and training, it should keep them safe for a period of time. But we don’t know where they are now. … They are very deep in the wilderness and coming in contact with someone else directly is difficult,” said Thompson. “They are experienced hikers, and it was very unlike them not to return from their hikes. This is why their families reported them missing,” he said.
Chandler and Nelson did not contact anyone for help once they set out on the hike. “The last time anyone heard from them are their parents before they took off for their hike. They didn’t text or call,” said Thompson.
West Linn High School, where Chandler is a senior and Nelson a junior, is preparing an administrative meeting to update school staff and students on the status of the rescue efforts.
“We have news that many of Jackson and Bradley’s friends are gathering out there at the rescue scene with their families to show support,” Lou Bailey, principal of West Linn High, told ABC News.
“Like everyone else involved in the search, we are in limbo waiting to hear any updates from the crews out there,” said Bailey. “The school cannot help out in the rescue because the normal public is not allowed out there. The area that Jackson and Bradley are at is very treacherous,” he said.
Search crews made some progress in their pursuit after they found the hikers’ truck on Sunday afternoon. “It was locked and the boys were not inside,” Thompson said.
ABC News tried to speak with the parents of Chandler and Nelson, but they were not available to talk.

Hurricane Sandy Arriving Early, To Hit Jersey Shore in the Evening.

A surging Hurricane Sandy rushed towards the East Coast today and is now expected to crash ashore this evening, hours earlier than previously expected.
Sandy's forward motion has accelerated to 28 mph and could make landfall somewhere between Atlantic City and Cape May around 6 p.m. or 7 p.m., Dennis Feltgen, a spokesman from NOAA's National Hurricane Center, told ABC News.
Previous estimates were for it hit Atlantic City about midnight.
Although Sandy was still hours away, most of Atlantic City was already under several feet of water as waves crashed over the sea wall, spitting up chunks of the famed boardwalk.
Atlantic City officials have implemented an emergency curfew from 6 p.m. to 6 a.m. and a travel ban has been put in effect -- and the worse of the storm has yet to arrive, according Atlantic County spokeswoman Linda Gilmore.
"The city's basically flooded," said Willie Glass, public safety director, according to the Associated Press. "Most of the city is under water."
Cars in the streets have water past their tires and planks from the famed Atlantic City boardwalk have washed up into the street. Garage doors were crushed and torn, with the structures caving in on themselves. Large trees have fallen, traffic lights are out, phone lines are down and several water rescues have occurred, according to Gilmore. Tens of thousands of people have lost power and many more outages are expected. Last year, Hurricane Irene left 7 million homes without power in the same area Sandy is expected to batter with wind and rain.

DAKAR, Sénégal, October 25, 2012/African Press Organization (APO)/ -- Due to the high demand from African innovators, The African Innovation Foundation (AIF) (http://www.africaninnovation.org) and the United Nations Economic Commission for Africa (ECA) announced the extension of the deadline for submitting entries to the Innovation Prize for Africa (IPA) (http://www.innovationprizeforafrica.org) to 30 November 2012.

At an event featuring Senegal's Minister and Deputy Chief of Staff of the President for the Republic of Senegal, Mr Moubarack Lo, the IPA team highlighted the need to invest in innovation to accelerate economic growth on the continent. The event in Dakar was organized in collaboration with the Senegalese Science Academy and Technology, represented its President, Professor Ahmadou Lamine Ndiaye.

"We know that innovation can be an engine for economic development. We continue to look for innovations that have commercial potential and are effective in the long term," said Pauline Mujawamariya of the African Innovation Foundation.

Only innovations by Africans for Africans are eligible to enter for the IPA 2013. Africans in the Diaspora can also apply if their innovations are of significance to Africa. The winning proposal will be awarded a cash prize of $100,000 USD, with the two runners-up each receiving $25,000 USD.

STATEMENT BY PRESIDENT GOODLUCK JONATHAN (EID-EL-KABIR MESSAGE TO NIGERIANS

Happy Salah Mr President.

 My Dear Compatriots,
 I extend warm greetings and felicitations to you all as we celebrate this year’s Eid-el-Kabir festival. I also congratulate all Nigerians who successfully undertook the Hajj this year despite the unforeseen difficulties which developed over the issue of male companions for some of our female pilgrims.

 Although the problem was eventually resolved with the positive intervention of the Federal Government, I have ordered a thorough post mortem of the incident with a view to ensuring that our Hajj airlift operations are never disrupted by such problems in future and that no Nigerian pilgrim is ever subjected to such traumatic experience in the Holy Land again.

 Nigerians remain a people of great faith with the vast majority of our people professing belief in God either as Muslims or Christians. I believe therefore that we should all seize the opportunity of the Sallah season and the public holidays to reflect on how we can bring the ideals and virtues of our religious beliefs to bear on the positive resolution of the many challenges facing us as a nation.

There can be no doubt that we will make faster progress towards the attainment of developmental objectives as a nation if we all resolve to do more to live up to the highest ideals of our religious beliefs including the fear of God, willingness to make personal sacrifices for the collective good, selfless service, respect for laws and constituted authorities, honesty, justice, equity, fairness, dutifulness, peace and harmonious co-existence with others.

My administration will continue to give dedicated, committed, focused and purposeful leadership towards overcoming old and emerging challenges before the nation.While our doors remain open for constructive engagement and dialogue with all Nigerians, we shall continue to aggressively implement all measures deemed necessary for the restoration and maintenance of peace in all parts of the country. As we celebrate the Eid-El-Kabir, let us all remember the plight of the many thousands of our compatriots who have been displaced by the floods which recently devastated many communities across the nation and resolve to contribute whatever we can to ameliorate their suffering.


I have already announced a relief package of close to N18 billion and constituted a national committee to raise more funds to help victims of the floods. In the true spirit of our major religions which enjoin us to be generous to the needy, I urge all Nigerians who can do so, to donate munificently to the national relief fund for affected persons and communities. We will monitor the disbursement and utilization of the funds released by the Federal Government and those raised by the National Committee very closely to ensure that they are judiciously and expeditiously expended for the benefit of the flood victims.

 May God bless and reward all who help the flood victims.

I wish all Nigerians who undertook the Hajj a safe journey back home

A prosecution witness yesterday told the Federal High Court, sitting in Abuja, that the senator representing Borno South Senatorial District, Mohammed Aliyu Ndume, gave the telephone number of the Attorney-General of the Federation (AGF) and Minister of Justice, Mr. Mohammed Adoke (SAN), to members of Boko Haram.
The witness, James Ene Izi, an Assistant Director with the State Security Service (SSS), said the jailed former spokesperson of the sect, Ali Konduga, revealed in his confessional statement that Ndume gave him the AGF's phone number and asked him to threaten the AGF that there would be more violence in Maiduguri should the then governorship election petition tribunal rule against the Peoples Democratic Party (PDP) in the state.
He also told the court, presided over by Justice Gabriel Kolawole, that Ndume confessed to having links with Boko Haram.
According to him, the accused confessed in a voluntary statement made to the SSS that he had telephone interactions with Konduga.
The officer added that when the senator and Konduga were made to face each other, Ndume claimed that he was meeting him (Konduga) for the first time in his life, even though evidence obtained from phones logs showed that they had been communicating.
Led in evidence by the prosecution counsel, Mr. Thompson Olatigbe, the witness further stated, “In the process of investigating Konduga, he mentioned the name of the accused person, one Saidu Pindar, who is now deceased and some of the politicians that have influenced the Boko Haram activities in Maiduguri.
“Upon this, we invited the accused person formally for interrogation and he made voluntary confessional statement where he admitted that he has links with the sect.”
He told the court that during investigation, Konduga’s phone number was found on Ndume's handset.
He, however, stated that Ndume said in his statement that what linked him with Konduga was his membership of the presidential committee set up to look into the insecurity in the North-east.
Under cross-examination by the defence counsel, Ricky Tarfa (SAN), the witness told the court that Konduga did not finger the senator as one of those financing the sect.
He also said that the investigative panel read in the confessional statement that he (Ndume) handed a compact disc obtained from Boko Haram to Vice-President Namadi Sambo and the Director General of the SSS.
Izi, however, stated that the panel did not have any audience with the vice-president to confirm Ndume’s claim, adding that part of the materials retrieved from the accused person’s house included a laptop, phones and an international passport.
Asked whether the panel read in Ndume's statement that he (Ndume) was threatened by Boko Haram, Izi answered in the affirmative, adding that the panel also read in the statement that the accused was a member of the presidential committee on the security challenges in the North-east.
After taking Izi’s evidence, Justice Kolawole adjourned further trial until December 1.

Ribadu Report Uncovers Sleaze in Oil and Gas Sector.

Nigeria has lost out on tens of billions of dollars in oil and gas revenues over the last decade from cut-price deals struck between multinational oil companies and government officials, a report of the Petroleum Revenue Special Task Force has said.
The 146-page document was produced by the 17-member task force, which is headed by the former Chairman of the Economic and Financial Crimes Commission (EFCC), Nuhu Ribadu, set up by the Minister of Petroleum Resources, Mrs. Diezani Alison-Madueke, in January. It covers the year 2002 to the present.
According to the Reuters news agency, the report provides new details on Nigeria's long history of corruption in the oil sector, which has enriched its elite and provided the oil majors with hefty profits while two thirds of the people live in poverty.
Alison-Madueke confirmed on Tuesday that she had received the report last month but that it was a draft and the government was still supposed to give its input. But the report submitted by the Ribadu committee was marked “final”.
The report concluded that oil majors - Shell, Total and Eni - made bumper profits from cut-price gas, while Nigerian oil ministers handed out licences at their own discretion.
This, while not illegal, did not follow best practice of using open bids. Hundreds of millions of dollars in signature bonuses on those deals were also missing, Reuters reported.
“We have not seen this report and are, therefore, unable to comment on the content, but we will study it if and when it is published,” a Shell spokesman said.
The report alleges that international oil traders sometimes buy crude without any formal contracts, and the Nigerian National Petroleum Corporation (NNPC) had short-changed the federation of billions of dollars over the last 10 years by selling crude oil and gas to itself below market rates.
There was no suggestion that the oil majors or traders had done anything illegal, but the report highlighted a lack of transparency in their dealings.
The Ribadu committee was among several set up by Alison-Madueke following a week of nationwide strikes against a rise in fuel prices in January, which morphed into a campaign against oil corruption.
It had as its terms of reference: To work with consultants and experts to determine and verify all petroleum upstream and downstream revenues (taxes, royalties, etc.) due and payable to the Federal Government of Nigeria;
• To take all necessary steps to collect all debts due and owing;
• To obtain agreements and enforce payment terms by all oil industry operators;
• To design a cross debt matrix between all Agencies and Parastatals of the Federal Ministry of Petroleum Resources;
• To develop an automated platform to enable effective tracking, monitoring, and online validation of income and debt drivers of all parastatals and agencies in the Federal Ministry of Petroleum Resources;
• To work with world-class consultants to integrate systems and technology across the production chain to determine and monitor crude oil production and exports, ensuring at all times, the integrity of payments to the Federal Government of Nigeria; and
• To submit monthly reports for ministerial review and further action.
The report shows that billions of dollars of revenue was missing in unpaid debts from signature bonuses and royalties.
Nigeria Liquefied Natural Gas (NLNG) Company, which is jointly owned by the NNPC, Shell, Total and Eni, had paid the country for gas at cut-down prices before exporting it to international markets, the report added.
Total and Eni declined to comment because they invest in but do not operate Nigeria LNG, a role held by Shell.
“The estimated cumulative of the deficit between value obtainable on the international market and what is currently being obtained from NLNG, over the 10-year period, amounts to approximately $29 billion,” the report said.
It also said foreign oil firms had outstanding debts.
Addax, now a unit of China's state-owned Sinopec, owes Nigeria $1.5 billion in unpaid royalties, part of a $3 billion black hole of unpaid bonuses and royalties owed by oil firms.
Addax did not respond to requests for comment, but the report noted it disputes owing the signature bonuses.
Shell owes Nigeria's government N137.57 billion ($874 million) for gas sold from its Bonga deep offshore field, the report said, while oil majors owed $58 million between them for gas flaring penalties. They were also not adhering to newer higher fines.
The report also revealed that Nigeria was the only nation to sell all its crude through international oil traders rather than directly to refineries, adding that such trades were often opaque.
It said some international oil traders who were not “on the approved master list of customers” had been sold crude oil “without a formal contract” so little could be obtained about the details of these deals, which can be worth hundreds of millions of dollars
.
“This logically will serve to reduce margins obtainable on sale of crude oil,” the report observed.
But Alison-Madueke disputed this, saying there are no informal contracts and there is “an official tender put out every year,” which could be seen by the public in newspapers.
NNPC gets an allocation of 445,000 bpd of crude oil to refine locally but has been selling its allocation at cut-down prices, a practice which cost Nigeria $5 billion in potential revenue between 2002 and 2011, the report said.
On this, the minister said: “NNPC buys at international rates.”
The report said the NNPC made N86.6 billion over the 10-year period by using overly generous exchange rates in its declarations to the government, but there was no sign of the money.
Oil ministers between 2008 and 2011 handed out seven discretionary licences but there is $183 million in signature bonuses missing from the deals, the report said. Three of these oil licences were awarded since Alison-Madueke took up her position in 2010, according to the report.
“I have not given any discretionary awards during this administration,” Alison-Madueke told Reuters, although she added that the president had the right to do so instead of using bids if he saw fit. “That is entirely up to him,” she said.
Among the report’s recommendations included NNPC being reorganised or scrapped, an independent review of the use of traders to be set up, and a transparency law that should be passed requiring oil companies to disclose all payments made to Nigeria.
U.S. regulators put new rules in place in August that will require U.S.-listed oil and gas companies to disclose payments they make to foreign governments like Nigeria.
But in a move aimed at providing clarity on her interview with Reuters, Alison-Madueke last night said that the reports of committees set up earlier in the year to investigate certain areas of Nigeria’s oil and gas sector would soon be delivered to the government.
In a statement from the acting General Manager Public Affairs of NNPC, Mr. Fidel Pepple, Alison-Madueke was quoted as telling Reuters that "the report is not normally put in the public domain until the government’s complete report is finalised.
“What normally happens when you set up a committee is that when the committee hands in its report, a team is put together by the arm of government or agency that set up the committee in the first place. That has already happened.
“That team consists of people with relevant experience in the area. So, it is not just about the Revenue Task Force. The Revenue Task Force handed in its report sometime in September. But there were also the Governance and Control and the Refineries Task Forces which have all sent in their draft reports."
She further said: "We have set up a team that is looking at them across the board to see if there is a difference in opinion or a difference in perspective. This team will complete its work and submit a comprehensive report in the next 10 days. It is only after then that government will talk about implementation and the issues that you mentioned would be addressed.
The minister told the news agency: “Government will decide on where to draw the line on any issue that is not in conformity with its policies. And some of the points that have been raised are, in fact, not as they have been presented.

“I am very careful not to comment on the report until it has been finalised. There are areas that have already been handled by these committees because they are not the way they were presented. That is why I’m very careful not to comment before we finalise.”
The minister also added that there were some “areas that I thought should be addressed because they come up very often in the media, such as the issue of discretionary awards. I have not given any discretionary award since the inception of this administration.
“What normally happens with discretionary awards is that they are part of marginal or major bid rounds. It is in the president’s power by law to grant discretionary awards or to go with competitive bidding or to go with a mixed bag when you have a bid round, and it is entirely up to him to decide which way to go.
“When the next marginal or major bid rounds will be done, they will be publicly announced. We do expect that within the next couple of months, the marginal bid rounds will be announced. We hope that the major bid round will follow before the end of the year.”

The Catholic Pontiff, Pope Benedict XVI, yesterday elevated the Archbishop of the Abuja Diocese, John Olorunfemi Onaiyekan, along with five others to the position of cardinal, barely two months after the retirement of the Archbishop of the Lagos Diocese, Anthony Cardinal Okogie.
He becomes the fourth Nigerian to attain that position after Dominic Cardinal Ekanem, who died in 1995, Francis Cardinal Arinze and Okogie.
Benedict, 85, announced the appointment of the new cardinals during his weekly general audience and said they would be formally elevated at a consistory on November 24.
With the new cardinals, there will be 120 cardinals under the age of 80 and thus eligible to vote in a conclave to elect a new pope. Europe still has the most number of cardinals, totalling 62.
Also, with the new additions, the College of Cardinals is more multinational in outlook, comprising 21 from Latin America, 14 from North America, 11 from Africa, 11 representing Asia and one from Oceania.
Onaiyekan, 68, and the five other new cardinals from the United States, India, Lebanon and the Philippines will be consecrated by the Pope.
President Goodluck Jonathan and Anambra State Governor, Peter Obi, in swift reactions to Onaiyekan’s elevation, said his new status was a testimony to his commitment to duty.
A statement by the Director of Communications, Catholic Archdiocese of Abuja, Rev. Fr. Thomas Asen, said notwithstanding his elevation, Onaiyekan would remain in Abuja to run the affairs of the archdiocese.
The new cardinal was a nominee for this year’s Nobel Peace Prize alongside the Sultan of Sokoto, Alhaji Muhammed Sa’ad Abubakar III, for the roles they played in maintaining peace and equilibrium in the face of the Boko Haram insurgency in the North.  He co-chairs the Nigeria Inter Religious Council (NIREC) with the sultan.
Reacting to his elevation, Onaiyekan described his appointment as “a great honour to Africa”.
“I see the elevation as a great honour to Africa, Nigeria, my country and (Nigeria's capital) Abuja. It is an encouragement for me to continue the good works that I have been doing for humanity,” he told AFP by phone from Rome.
He has won widespread respect for his efforts to ease religious tensions in Nigeria by using the pulpit to speak against mis-governance and build bridges between Islam and Christianity.
Onaiyekan, who holds a doctorate in biblical theology, was ordained a Catholic priest in 1969 and appointed by the late Pope John Paul II a permanent member of the Synod of Bishops in Rome.
The cardinals are the Pope's closest aides in the Vatican, where they run its key departments, and around the world, where they head dioceses to administer the 1.2 billion members of the Roman Catholic Church.
The other cardinals named yesterday included Beatitude Bechara Boutros Rai, 72, the patriarch of the Maronite Catholic Church in Lebanon and Archbishop James Michael Harvey, an American who is based in the Vatican.
Harvey, 63, whose title is Prefect of the Pontifical Household, looks after world leaders visiting the Vatican and arranges the Pope's audiences. A native of Milwaukee, Harvey, who was the direct superior of the Pope’s former butler, Paolo Gabriele, has worked in the Vatican for more than two decades.
Another new cardinal, Baselios Cleemis Thottunkal, 53, the major Archbishop of the Syro-Malankara rite in India, is on the frontline of inter-religious dialogue with Hinduism faithful.
The other two come from predominantly Catholic countries - Archbishop Ruben Salazar Gomez, 70, of Bogota, Colombia, and Archbishop Luis Antonio Tagle, 55, of Manila in the Philippines, which is the largest Catholic country in Asia.
Benedict has now named 67, or more than half, of the cardinals who will elect his successor from among their own ranks. Fifty-three others were named by Pope John Paul, but Italians are still by far the largest group of cardinal electors with 28 members.
Congratulating Onaiyekan on his elevation, a statement by President spokesman, Dr. Reuben Abati, said Jonathan believed that the elevation clearly showed the cardinal as diligent, dedicated and committed to his calling.
“The exemplary diligence, dedication and commitment with which he has gone about his labours in the Lord’s vineyard since his ordination in 1969 has been recognised and appreciated,” he said.
According to him, with his elevation, Nigeria “now has three members of the most eminent and distinguished College of Catholic Cardinals. This as an indication by the Vatican of its continuing recognition of the immense contributions of the church in Nigeria to the worldwide Catholic movement.”
The president prayed that God Almighty would grant Onaiyekan continued good health, strength, wisdom and divine guidance required to discharge his new responsibilities.
Obi, in a congratulatory letter to Onaiyekan, said it was both a divine favour and recognition of personal merit.
“No one can contest that in your capacity as a pastor, you have shown great devotion to your calling. And as a religious leader, you have displayed sensitivity to the mood and makeup of our society in the handling of religious issues.
“The appointment once more puts Nigeria in the global spotlight but for salutary reasons. Your selection makes a strong statement that we can offer the best to the world in every endeavour,” he said.

He came up with a solution: Once he started working with Spears, he began texting photographers to tell them where he and Spears were going in an attempt to stop them from following her. "I was also setting up private meetings with Britney and press photographers at her home, so [they] could get to know her as a human being," he said.

Spears May Have Shaved Her Head Over Fear of Drug Tests
In court, Lutfi's lawyer claimed that Spears' infamous 2008 head shaving happened after someone told her she could be tested for drugs with samples of her hair and would lose custody of her children if she tested positive. He said that prompted her decision to dive into a San Fernando Valley salon and buzz off her locks.

Barry Weiss, the former CEO of Jive Records who signed Spears when she was 16, said he never considered Lutfi to be Spears' manager, partly because he was the man Spears came to during her times of crisis.
